1. Introduction
Welcome to Thynkering Technologies. These Terms & Conditions (“Terms”) govern your access to and use of our website, services, and any products provided by Thynkering Technologies (“we”, “us”, “our”). By visiting our website or engaging our services you agree to be bound by these Terms.
2. Our Services
We design, build and deliver custom websites, web and mobile applications, white-label solutions and analytics/insights dashboards. Specific terms for a particular engagement will be set out in a separate proposal, statement of work, or service agreement.
3. Accounts & Booking
To schedule calls, request proposals or access certain parts of our services you may be asked to provide contact information and project details. You warrant that all information you provide is accurate and that you are authorised to provide it on behalf of any business you represent.
4. Intellectual Property
Unless otherwise agreed in writing, we (or our licensors) retain ownership of all intellectual property rights in the designs, source code, templates, and materials we create. Upon full payment and as specified in the project agreement, we will grant you the rights necessary to use the delivered product for your business purposes. Third-party libraries or licensed components included in a product remain subject to their own licences.
5. Client Content
You retain ownership of content, data and materials you provide to us. By providing such content you grant us a limited licence to use, reproduce and modify it for the purpose of delivering the services.
6. Fees, Quotes & Payment
Project fees, deposits, and payment schedules will be outlined in our proposal or service agreement. If payment is not made in accordance with agreed terms we reserve the right to suspend work until payment is received. All fees are quoted in the currency specified in the proposal.
7. Warranties & Liability
We provide our services using reasonable skill and care. Except where expressly stated, we provide our services “as is” and do not make any other warranties. To the fullest extent permitted by law, our liability for any loss or damages arising in connection with these Terms is limited to the total fees paid to us for the specific services giving rise to the claim.
8. Confidentiality
We will keep confidential any non-public information you reasonably identify as confidential. We may disclose such information if required by law, regulation, or court order.
9. Data Protection & POPIA
We process personal information in accordance with applicable laws. Where relevant we will comply with the Protection of Personal Information Act (POPIA) of South Africa. Our Privacy Policy below explains how we collect, use and protect personal information. By using our services you consent to such processing as described in that policy.
10. Third-Party Services
Our solutions may integrate third-party services (hosting, analytics, payment processors, scheduling tools). Use of those services is also subject to the third-party provider's terms and privacy policies.
11. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised “Last updated” date. Continued use of our services after changes constitute acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of South Africa. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the South African courts.
